TikTok Sues Montana Over Its New Law Banning The App

TikTok has filed a lawsuit against the state of Montana for their unconstitutional ban on the app. The law makes it illegal for app stores to offer downloads of the app and for the company to operate within the state.

The complaint states that the ban violates a federal preemption, the constitution's Commerce Clause, and unfairly singles out TikTok. Gov. Greg Gianforte had drafted an amendment to the bill that would have changed its language to target all social media, but the amendment did not make it into the final bill.

Five TikTok content creators have also filed a lawsuit against the state, claiming the ban attempts to suppress speech. The ban is scheduled to take effect Jan. 1, 2024 and violations could carry a $10,000 penalty.
